TestLessons Terms of Service
Please read these Terms of Service ("Terms") carefully before accessing or using the testlessons.com website, any subpages, sign-in or account features, or any content, prompts, practice materials, or services available through it (the "Service"), operated by Drialta Holding LLC d/b/a TestLessons ("us," "we," "our," or "TestLessons").
Acceptance of Terms
By accessing, browsing, creating an account, or using any part of the Service, you agree to be bound by these Terms and our Privacy Policy (available at https://testlessons.com/privacy/), which is incorporated by reference. If you do not agree, do not use the Service.
Description of Service; Free of Charge
TestLessons provides free educational resources and tools intended to help students prepare for standardized tests, including the Digital SAT, ACT, GRE General Test, GMAT Focus Edition, LSAT, and MCAT. The Service includes expert-crafted prompts and guidance for effective use of artificial intelligence tools, practice questions, study guides, instructional content, strategies, and related materials. The Service is offered free of charge.

THE SERVICE AND ALL CONTENT (INCLUDING PRACTICE QUESTIONS, ANSWERS, EXPLANATIONS, STUDY GUIDES, PROMPTS, INSTRUCTIONAL MATERIALS, AND ANY AI-ASSISTED OR GENERATED CONTENT) ARE PROVIDED STRICTLY "AS IS" AND "AS AVAILABLE," FREE OF CHARGE, WITHOUT ANY WARRANTIES OR REPRESENTATIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. THIS INCLUDES, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, TIMELINESS, OR ERROR-FREE OR UNINTERRUPTED OPERATION.
TO THE FULLEST EXTENT PERMITTED BY LAW, TESTLESSONS MAKES NO WARRANTIES AND DISCLAIMS ALL LIABILITY REGARDING THE ACCURACY, COMPLETENESS, CORRECTNESS, SUITABILITY, OR RELIABILITY OF ANY CONTENT. CONTENT MAY CONTAIN ERRORS, OMISSIONS, INACCURACIES, BE OUTDATED OR INCOMPLETE, OR FAIL TO REFLECT THE LATEST TEST FORMATS, SCORING, OR OFFICIAL GUIDELINES. ARTIFICIAL INTELLIGENCE SYSTEMS OR PROMPT-BASED TOOLS CAN PRODUCE INCORRECT, MISLEADING, BIASED, OR INCOMPLETE OUTPUTS ("HALLUCINATIONS").
You acknowledge and agree that:
You must NOT rely on the Service or any content for test preparation, studying, or any other purpose without independently verifying all information against official materials from the relevant testing organizations (College Board, ACT, ETS (Educational Testing Service), GMAC (Graduate Management Admission Council), LSAC (Law School Admission Council), AAMC (Association of American Medical Colleges), etc.), current textbooks, and authoritative sources.
TestLessons makes no guarantee, promise, or representation that use of the Service (or any prompts, practice materials, or strategies) will improve your scores, help you pass any exam, secure admission, or achieve any educational or professional goal. Results depend on many factors outside our control.
Any reliance on the content or Service is solely at your own risk. We are not responsible for any consequences of inaccuracies or reliance, including poor test performance, mislearning, ineffective strategies, or other damages.
The Service is a supplementary educational aid only and is NOT a substitute for official test-preparation materials, classes, tutoring, or dedicated personal study.
TestLessons is NOT affiliated with, endorsed by, sponsored by, or connected to the College Board, ACT, Inc., ETS (Educational Testing Service), GMAC (Graduate Management Admission Council), LSAC (Law School Admission Council), AAMC (Association of American Medical Colleges), or any other testing organization. References to test names or formats are for informational purposes only.
By using the Service you confirm you understand and accept these risks and disclaimers.
User Accounts
Certain features (such as saved prompts, progress tracking, or personalized study plans) may require creating an account. If you create an account:
You agree to provide accurate, current, and complete information and to keep it updated.
You are solely responsible for the confidentiality of your credentials and for all activity under your account.
Notify us immediately of any unauthorized use or security issue.
We may suspend, terminate, or refuse accounts at our sole discretion for violations of these Terms or other reasons.
Account-related data is handled according to our Privacy Policy.
User Conduct and Prohibited Uses
You agree not to use the Service to:
Violate any law or regulation or the rights of others.
Upload or transmit viruses, malware, or malicious code.
Engage in conduct that disrupts or restricts others' use of the Service.
Scrape, crawl, harvest, or use automated means to access or collect content en masse without prior written permission.
Reproduce, distribute, publicly display, modify, create derivative works from, or commercially exploit any content except for your own personal, non-commercial educational use as expressly permitted.
Use content to train AI models, build datasets, or create competing products or services without our express written consent.
Facilitate or engage in academic dishonesty or violate the rules of any testing organization.
Reverse engineer, decompile, or attempt to derive source code or underlying ideas from any part of the Service (where applicable).
We reserve the right to remove content or terminate access for violations.
Intellectual Property and Limited License
The Service and all original content, features, functionality, prompts, design, and trademarks are and remain the exclusive property of Drialta Holding LLC and its licensors, protected by copyright, trademark, and other laws.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service and content solely for your personal, non-commercial educational purposes. This license does not include any right to resell, redistribute, commercially exploit, or create derivative works. Any unauthorized use automatically terminates the license and may subject you to legal action.
Links to Third-Party Sites and Services
The Service may contain links to third-party websites, tools, or services (including those referenced in prompts or guidance). We have no control over and assume no responsibility for their content, privacy practices, or availability. Your use of third-party services is at your own risk and subject to their terms.
Termination
We may terminate or suspend your access or account immediately, without notice or liability, for any reason, including breach of these Terms. Upon termination, your license ends and you must stop using the Service. Provisions that by their nature should survive (disclaimers, IP, liability limits, indemnification, governing law, etc.) will survive termination.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DRIALTA HOLDING LLC, ITS MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING LOST PROFITS, DATA LOSS, GOODWILL, BUSINESS INTERRUPTION, OR PERSONAL INJURY) ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICE OR CONTENT, REGARDLESS OF THE LEGAL THEORY AND WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
BECAUSE THE SERVICE IS PROVIDED FREE OF CHARGE, OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS SHALL NOT EXCEED THE GREATER OF ZERO DOLLARS ($0) OR THE TOTAL AMOUNT YOU PAID TO US FOR THE SERVICE (WHICH IS $0).
THESE LIMITATIONS APPLY EVEN IF ANY REMEDY FAILS ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS; IN THOSE CASES, LIABILITY IS LIMITED TO THE MINIMUM EXTENT REQUIRED BY LAW.
Indemnification
You agree to indemnify, defend, and hold harmless Drialta Holding LLC and its members, managers, officers, directors, employees, agents, affiliates, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you provide or any reliance on or misuse of Service content.
Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Fairfield County, Connecticut (or, at our election, through binding individual arbitration in Fairfield County under the rules of the American Arbitration Association). You waive any right to a jury trial and agree that disputes will be on an individual basis only (no class actions). Nothing prevents us from seeking injunctive relief in any appropriate court for intellectual property or confidentiality breaches.
Changes to These Terms
We may modify these Terms at any time at our sole discretion. Material changes will be posted on the Service with an updated "Last Updated" date. If you have an account, we may also attempt to notify you via the email associated with your account. Your continued use of the Service after the effective date of any changes constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.
General Provisions
These Terms, together with the Privacy Policy, constitute the entire agreement between you and TestLessons concerning the Service and supersede all prior agreements. If any provision is found invalid or unenforceable, the remaining provisions remain in full force. No waiver of any provision is effective unless in writing. We may assign these Terms; you may not assign them without our prior written consent. These Terms do not create any agency, partnership, or employment relationship.
